OVERVIEW
Welcome to Mobility Companion! The terms “we”, “us” and “our” refer to Mobility Companion, a trading name of CECILE HEALTHCARE UK LIMITED (Company No. 13723411). We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Mobility Companion is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the “Terms”) describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, warranty disclaimers and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy (available at mobilitycompanion.co.uk/privacy). If you do not agree, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction, and you consent to allow any minor dependants to use the Services on devices you own or manage.
To use the Services (including browsing or purchasing), you may be asked to provide information (e.g., email, billing and payment details, addresses). You represent and warrant that such information is accurate, current, and complete, and that you have the right to provide it. You are responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer or license your account to any other person.
SECTION 2 – OUR PRODUCTS AND SERVICES
We make every effort to describe products and services accurately. Colours, dimensions, or appearance may vary due to device settings. Descriptions and availability may change at any time without notice. We may discontinue any product or service at any time and may limit quantities or access on a case-by-case basis.
SECTION 3 – ORDERS
When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion. Your order is accepted when we confirm and process your payment. Please review orders carefully before submitting; we may not be able to accommodate cancellations after acceptance. If we do not accept or must change/cancel an order, we will attempt to notify you using the contact details you provided at checkout.
Purchases are for personal/household use and not for commercial resale or export. Returns and refunds (where applicable) are governed by our Refund Policy (mobilitycompanion.co.uk/refunds).
SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged is the price in effect at the time of order and appears in your confirmation email. Unless expressly stated, prices exclude taxes, fees, and charges (e.g., delivery, tolls, congestion/ULEZ, airport charges).
You agree to provide current, complete, and accurate purchase and payment information and to promptly update details (e.g., card expiry) so we can complete transactions and contact you as needed. You warrant that you are authorised to use the payment method and that all charges will be honoured.
SECTION 5 – SERVICE DELIVERY, SHIPPING & DELAYS
For physical goods (e.g., vouchers, accessories), delivery times are estimates only and not guaranteed. Title and risk of loss pass to you when goods are handed to the carrier. We are not liable for carrier/customs delays or events beyond our control.
For transport bookings, timing is subject to traffic, road closures, and other unforeseen events. We will act reasonably to meet agreed pickup times, but we do not guarantee arrival times. Additional on-the-day charges (e.g., parking/tolls/airport fees) may apply if not included in a fixed fare and will be communicated wherever possible.
SECTION 6 – INTELLECTUAL PROPERTY
All content on the Services (including text, graphics, logos, icons, images, audio/video, and their selection/arrangement) is owned by Mobility Companion, its affiliates or licensors, and is protected by applicable intellectual property laws. You may use the Services for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works without prior written consent.
“Mobility Companion” and associated logos are trademarks of Cecile Healthcare UK Limited or its licensors. You may not use our trademarks without prior written permission.
SECTION 7 – OPTIONAL TOOLS
We may provide access to third-party tools “as is” and “as available” without warranties. We have no control over third-party tools and assume no liability arising from your use. Use is at your own risk and governed by the third party’s terms.
SECTION 8 – THIRD-PARTY LINKS
The Services may contain links to third-party websites or content. We are not responsible for examining or evaluating third-party materials and do not warrant or endorse them. Your use of third-party sites is at your own risk and subject to their policies and terms.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify. However, your purchases are made directly with Mobility Companion. Shopify is not responsible for your transactions with us and is released from claims arising from such transactions.
SECTION 10 – PRIVACY
We process personal information in line with our Privacy Policy (mobilitycompanion.co.uk/privacy) and Shopify’s privacy practices. Because our store is hosted by Shopify, information you submit may be processed by Shopify and its sub-processors (which may be outside the UK). By using the Services, you consent to such processing.
Healthcare context: Mobility Companion is operated by CECILE HEALTHCARE UK LIMITED, a CQC-registered provider (Provider ID: 1-12588494532). Where bookings involve care or support information, we handle such data with enhanced confidentiality and in accordance with applicable data protection law. See our Privacy Policy for details.
SECTION 11 – FEEDBACK AND REVIEWS
If you submit reviews, suggestions, or feedback, you grant us a perpetual, worldwide, royalty-free licence to use and publish that content for business purposes. You represent you have rights to the content and that it complies with law and these Terms. We may monitor, edit, or remove content we consider unlawful, offensive, or infringing.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Information on the Services may occasionally contain errors or omissions (e.g., pricing, availability). We reserve the right to correct or update information or cancel orders if information is inaccurate at any time without notice (including after submission).
SECTION 13 – PROHIBITED USES
You agree not to use the Services for unlawful purposes; to infringe intellectual property or privacy rights; to harass, abuse or defame; to upload malware; to attempt unauthorised access; to scrape or mine data without consent; or to interfere with the security or operation of the Services. We may suspend or terminate access for violations.
SECTION 14 – TRANSPORT SERVICE CONDITIONS
For accessible transport and companion services:

Eligibility & Assistance: Our carer-drivers provide door-to-door support. If you require specific assistance (e.g., wheelchair securement, dementia support), please tell us at booking so we allocate appropriately.

Safety: Seatbelts/restraints must be used. We may refuse/terminate a journey if safety is compromised (e.g., aggressive behaviour, intoxication beyond safe travel).

Waiting/No-Show: Reasonable waiting is included where stated. Additional waiting beyond the included allowance may be chargeable at published rates. No-shows may be charged in full.

Medical Advice: We do not provide clinical advice. In emergencies, call 999.
SECTION 15 – DISCLAIMER OF WARRANTIES
Except as expressly stated by Mobility Companion, the Services and all products/services are provided “as is” and “as available.” We do not warrant uninterrupted, timely, secure, or error-free operation, nor the accuracy or reliability of results. Applicable law may not allow the exclusion of implied warranties; to the extent not permitted, such exclusions do not apply.
SECTION 16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Mobility Companion, its directors, officers, employees, and affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services or any product/service, even if advised of the possibility. Our aggregate liability to you for any claim shall not exceed the amount paid by you to us for the transaction giving rise to the claim.
SECTION 17 – INDEMNIFICATION
You agree to indemnify and hold harmless Mobility Companion, Shopify, and our affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your misuse of the Services.
SECTION 18 – SEVERABILITY
If any provision is held unlawful or unenforceable, that provision will be enforced to the maximum extent permissible and the remainder will remain in full force.
SECTION 19 – WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision is not a waiver. These Terms, together with policies referenced herein (including our Privacy and Refund Policies), are the entire agreement between you and us regarding the Services and supersede prior agreements.
SECTION 20 – ASSIGNMENT
You may not assign or transfer these Terms or your rights/obligations hereunder without our prior written consent. We may assign or transfer without restriction.
SECTION 21 – GOVERNING LAW
These Terms and any dispute or claim (including non-contractual disputes) are governed by the laws of England and Wales. You and Mobility Companion submit to the exclusive jurisdiction of the courts of England and Wales.

Headings are for convenience only and do not affect interpretation.
SECTION 23 – CHANGES TO TERMS OF SERVICE
We may update these Terms at any time by posting the revised version on our website with an updated “Last Updated” date. Material changes will be notified in accordance with applicable law. Your continued use after the effective date constitutes acceptance.
